Acceptance of terms
By accessing or using any part of swiftpassimmigration.com or SwiftPass mobile applications ("Platform"), you affirm that you:
- Are at least 18 years of age, or have obtained parental or guardian consent
- Have the legal capacity to enter into binding contracts in your jurisdiction
- Are not barred from receiving services under applicable law
- Have read, understood, and agree to be bound by these Terms and our Privacy Policy
Section 02
Our services
SwiftPass Global LLC provides visa application facilitation services. We assist individuals in preparing, organizing, and submitting visa applications to the appropriate embassy or consulate. Our services include:
Application processing
Review, preparation, and submission of your visa application to the target embassy or consulate on your behalf.
Document review
Professional review of your supporting documents to identify deficiencies before embassy submission.
Expert consultation
One-on-one sessions with licensed immigration consultants to guide your visa strategy.
Embassy fee payment
Optional service to deposit government visa fees with us — we handle the embassy payment on your behalf (+$45 convenience fee).
Application tracking
Real-time status updates on your application progress through your SwiftPass dashboard.
Section 03
User accounts
To access most SwiftPass features, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information when it changes
- Keep your login credentials strictly confidential
- Accept full responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized account access at support@swiftpassimmigration.com
SwiftPass reserves the right to suspend or terminate accounts that provide false information, violate these Terms, or engage in fraudulent activity. We are not liable for losses resulting from unauthorized use of your account due to your failure to secure your credentials.
Section 04
Payment terms
Service fees
All service fees are displayed in USD and are due in full at the time of purchase. By completing payment, you authorize SwiftPass to charge the stated amount to your chosen payment method.
Government visa fees
Payment methods
- Credit and debit cards (Visa, Mastercard, Amex) via DPO Pay
- M-Pesa mobile money (Kenya)
- Stripe and PayPal where available
Currency & taxes
All transactions are processed in USD unless otherwise specified. You are responsible for any applicable taxes, import duties, or transaction fees levied by your local jurisdiction or financial institution.
Refunds
Refunds are governed exclusively by our Refund Policy, which is incorporated into these Terms by reference. All payments are final once made, save for the single exception (SwiftPass service failure) and the limited discretionary cases set out in the Refund Policy. Please review it carefully before purchasing.
Immediate performance & cooling-off waiver
By completing payment, you expressly request and authorise SwiftPass to begin work immediately and acknowledge that performance commences upon order confirmation. Where a statutory cancellation or “cooling-off” period would otherwise apply to digital or professional services, you expressly consent to immediate commencement and waive that cooling-off right to the fullest extent permitted by law.
Chargebacks & payment disputes
You agree to raise any billing concern with us first, through your account dashboard. Filing a chargeback with your bank or card issuer — particularly after a service has been delivered, an appointment has been booked, or an application has been submitted — is a breach of this agreement and constitutes payment fraud where the service was rendered. In such cases SwiftPass may, at its discretion: permanently suspend or terminate your account and block future access across all identifiers and devices; forfeit any pending or discretionary refund; contest the dispute with the card scheme using our complete, timestamped evidence record (your acceptance of these Terms with timestamp, IP address and device; application activity logs; documents you uploaded; work delivered and appointment confirmations; and all correspondence); recover any resulting costs, fees, and losses; and report confirmed first-party fraud to the relevant networks and authorities.
Section 05
User obligations
By using SwiftPass, you represent, warrant, and agree that:
- All information and documents you submit are accurate, complete, and authentic to the best of your knowledge
- You will not submit forged, falsified, or misleading documents under any circumstances
- You will respond promptly (within 48 hours) to requests for additional information or documents
- You are the person identified in the application, or have legal authority to submit on behalf of the applicant
- You understand that visa denial by an embassy does not entitle you to a refund of government fees
- You will comply with all applicable laws in your use of our platform
- You have obtained necessary consent to share personal data of third parties (e.g., travel companions) with SwiftPass
Section 06
Prohibited activities
The following activities are strictly prohibited on the SwiftPass platform:
- Submitting fraudulent, forged, or materially misleading information or documents
- Impersonating another person or entity
- Attempting to gain unauthorized access to other user accounts or our systems
- Using automated bots, scrapers, or scripts to access or extract platform data
- Interfering with the platform's infrastructure, security, or other users' experience
- Using SwiftPass to facilitate any illegal immigration activity
- Reproducing, distributing, or reselling SwiftPass services or content without authorization
- Reverse engineering, decompiling, or attempting to extract source code from our platform
- Uploading malware, viruses, or any code designed to damage or disrupt our systems
- Engaging in harassment, abuse, or threatening behavior toward SwiftPass staff or other users
Violation of these prohibitions may result in immediate account termination, legal action, and reporting to relevant law enforcement agencies.
Section 07
Intellectual property
All content on the SwiftPass platform — including but not limited to software, source code, design, logos, trademarks, text, graphics, and data — is owned by or licensed to SwiftPass Global LLC and is protected under applicable intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our platform solely for your personal visa application needs. This license does not include the right to:
- Modify, adapt, or create derivative works of our platform or content
- Sublicense or transfer the rights granted to any third party
- Use our trademarks or branding without prior written consent
- Commercially exploit any part of our platform or content
All rights not expressly granted are reserved by SwiftPass Global LLC.
Section 08
Disclaimers
No guarantee of visa approval
SwiftPass provides visa application facilitation only. Visa decisions are made exclusively by sovereign government authorities. We make no representation, warranty, or guarantee that your visa application will be approved. Past approval rates do not guarantee future outcomes.
Platform provided "as is"
To the maximum extent permitted by law, SwiftPass is provided "as is" and "as available" without warranties of any kind — express, implied, or statutory — including merchantability, fitness for a particular purpose, or non-infringement.
Accuracy of information
While we strive to keep visa requirements and fee information current, immigration laws change frequently. SwiftPass does not guarantee the accuracy, completeness, or timeliness of visa requirement information displayed on our platform. Always verify current requirements directly with the relevant embassy.
Third-party services
SwiftPass may link to or integrate third-party services. We are not responsible for the content, privacy practices, or actions of third-party websites or services.
Section 09
Limitation of liability
To the maximum extent permitted by applicable law, SwiftPass Global LLC, its directors, officers, employees, agents, and affiliates shall not be liable for:
- Visa denial or rejection by any government authority
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, goodwill, or business opportunity
- Losses arising from embassy closures, government policy changes, or force majeure events
- Delays caused by incomplete or inaccurate information provided by you
- Any loss or damage arising from unauthorized access to your account due to your own negligence
Section 10
Indemnification
You agree to indemnify, defend, and hold harmless SwiftPass Global LLC and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising out of or related to:
- Your violation of these Terms
- Your submission of false, fraudulent, or misleading information or documents
- Your use of the platform in violation of any applicable law or regulation
- Any claim by a third party arising from your actions in connection with SwiftPass
Section 11
Termination
SwiftPass reserves the right to suspend or permanently terminate your account and access to our services, at our sole discretion, with or without notice, in the event that:
- You violate any provision of these Terms
- You provide false or fraudulent information
- Your account is used for prohibited activities
- Continued provision of services creates legal or regulatory risk for SwiftPass
- Required by applicable law or order of a competent authority
You may terminate your account at any time by contacting support@swiftpassimmigration.com. Termination does not affect any refund rights or obligations that existed prior to termination. Sections 07, 08, 09, 10, and 12 of these Terms survive termination.
Section 12
Governing law & dispute resolution
Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict-of-law provisions.
Informal resolution
Before initiating formal legal proceedings, both parties agree to attempt to resolve disputes informally. Contact us at legal@swiftpassimmigration.com with a written description of the dispute. We will respond within 30 days.
Arbitration
If informal resolution fails, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted in Delaware, USA. The arbitrator's award shall be final and binding.
Class action waiver
Section 13
Phone, SMS & AI-assisted call consent
By providing a phone number during registration, application, or any subsequent update to your SwiftPass account, you expressly consent to SwiftPass contacting you by voice call and SMS for all matters related to your account and applications. Permitted purposes include but are not limited to: application status updates, document requests, appointment reminders, refund and dispute resolution, customer support, and account security notifications.
AI-assisted calls. You acknowledge and consent that some of these calls may be placed by an AI assistant operating on behalf of the SwiftPass team. Our AI assistant identifies its nature to recipients at the start of each call or on direct request.
Call recording. You acknowledge that outbound and inbound voice calls between SwiftPass and you may be recorded for quality assurance, training, and compliance purposes. Recording disclosure is made at the start of each call. Recordings are encrypted at rest and retained for a maximum of 90 days. Full recording-retention and processing terms are set out in our Privacy Policy.
Time-of-day. Outbound calls are placed only between 9:00 AM and 7:00 PM in the recipient's local timezone, determined by the country code of the provided phone number.
Revoking consent. This consent is revocable at any time by replying STOP to any SMS message, by saying "remove me" or "stop calling" during any call, or by emailing privacy@swiftpassimmigration.com. Revocation is permanent. Critical transactional notifications related to an active application may continue via email after a phone opt-out so that you do not miss time-sensitive deadlines (e.g., embassy appointment reminders).
Standard rates. Standard message and data rates from your mobile carrier may apply to inbound and outbound SMS messages.
SwiftPass operates this voice communication program in alignment with applicable laws including the US Telephone Consumer Protection Act (TCPA), the California Bot Disclosure Law (SB 1001), the EU AI Act, GDPR, the Kenya Data Protection Act, the Ghana Data Protection Act, the Nigeria Data Protection Act (NDPA), and the Pakistan Personal Data Protection Act.
Section 14
Changes to these Terms
We may update these Terms from time to time to reflect changes in our services, technology, legal requirements, or business practices. When we make material changes, we will update the “Last updated” date above and, where appropriate, notify you by email or through your dashboard.
Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. The version of these Terms in effect at the time you place an order governs that order. If you do not agree to the revised Terms, you must stop using the Platform.
Section 15
General provisions
Entire agreement & no reliance
These Terms, together with our Privacy Policy and Refund Policy (each incorporated by reference), constitute the entire and exclusive agreement between you and SwiftPass Global LLC regarding the Platform and your orders, and supersede and override all prior or contemporaneous statements of any kind — including any website content, pricing page, blog, advertisement, marketing material, live chat, AI-assistant message, social-media post, or verbal or written statement by any person. Any estimate (including processing times and embassy/appointment availability or speed) is a general estimate only and is not a promise or guarantee. You agree that you have not relied on any representation, promise, or estimate not expressly set out in these Terms, and that no such statement forms part of this agreement or creates any obligation. In the event of any conflict, the written terms of this agreement control.
Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of SwiftPass.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. SwiftPass may assign these Terms, in whole or in part, including in connection with a merger, acquisition, reorganisation, or sale of assets.
Force majeure
SwiftPass is not liable for any failure or delay in performance caused by events beyond our reasonable control, including embassy or government action, closures, strikes, outages, payment-provider failures, natural disasters, war, civil unrest, pandemics, or other force-majeure events.
Time limit on claims
